SERVICE TERMS AND CONDITIONS


GARRISON™ SYSTEMS, LLC. - HAMMERHEAD™ SERVICE PLAN TERMS

1. Agreement and eligibility

These Service Terms and the signed Service Order govern the Hammerhead Annual Service Plan ("Plan") between the contracting entity identified in the Service Order, operating as Garrison Flood Control ("Garrison"), and the identified client ("Client"). The Plan covers only the Hammerhead™ Aluminum Flood Barrier System, openings, and components listed for the enrolled property ("System").

The Plan is available only for Florida Systems purchased and installed directly through Garrison. Ship-only orders, dealer purchases, and installations performed independently by third parties are ineligible. Eligibility, covered scope, and property-specific charges must be confirmed before payment. Additional properties or openings require written approval.

2. Payment and renewal

The annual Plan fee is $495, for up to 5 openings and $25 per additional opening, plus applicable. Any additional charges for suggested replacement materials or components will be billed separately upon approval.

The Plan does not renew automatically. Garrison will provide proposed renewal pricing and scope roughly 60 days before the next service year. Renewal requires the Client's affirmative acceptance.

3. Included annual services

The annual Plan includes one on-site visit by a Garrison installer to inspect accessible Hammerhead System components, mounting areas, and installation points; perform routine re-caulking where needed; review visible wear, damage, and missing components; and recommend replacement parts or additional maintenance. The Plan also includes the parts benefits in Section 4.

The inspection is a visual and functional review of accessible components, not an engineering certification, destructive investigation, flood-load test, or full deployment drill.

Critical findings will be communicated and suggested additional work will be communicated promptly. Garrison may retain service-related photographs and records at its discretion.

4. Replacement-parts credit and discount

The Client receives a $100 credit toward eligible, non-warranty related replacement parts for the covered System during the service year. After the credit is applied, a 15% discount applies to the remaining eligible-parts that may be purchased separately.

The credit and discount do not apply to labor, travel, taxes, shipping, or unrelated products. Unused credit has no cash value and does not carry forward, except when Garrison delays fulfillment of an approved order. Parts owed under a valid product-warranty claim do not use the credit and are not treated as discounted purchases.

5. Service year and seasonal service window

Each service year runs from December 1 through November 30. Routine service is scheduled as follows:

  • Service Plan Window: October 15 - April 30

  • Request deadline: At least 30 days in advance of desired service date

    • *We will do our best to accommodate your desired service date but dates are not guaranteed

  • No routine maintenance: June 1 - October 14th

8. Appointment requests and confirmation

The Client must submit a completed Hammerhead Service Request Form (to be provided upon order) at least 30 calendar days before the requested appointment and no later than March 31. The form must include property address, storage and access information, an authorized contact, and at least two acceptable appointment options.

A request does not confirm an appointment. Garrison will acknowledge the request within three business days and provide scheduling options within five business days. Appointments may be grouped by region and are confirmed in writing with a date and arrival window. Confirmed service is not contingent on additional nearby bookings.

9. Rescheduling, cancellation, and no-access fees

The Client must provide written notice at least 72 elapsed hours before the start of the confirmed arrival window, measured in the property's local time. A $125 fee applies to late cancellation, late rescheduling, or failure to provide required access or an authorized representative. No appointment fee applies when Garrison cancels, due to dangerous weather or an evacuation prevents access, or Garrison arrives outside the agreed window without the Client's consent.

10. Property access and condition

The Client authorizes Garrison personnel to access the covered installation, component-storage areas, and necessary work areas solely to perform the agreed services. The Client shall obtain required owner, association, tenant, or security permissions and provide clear pathways, safe working conditions, necessary utilities, secured pets, and reasonable parking.

An authorized adult representative must remain present throughout the appointment to provide access, receive findings, and approve additional work. Keys or access codes alone are insufficient unless Garrison agrees otherwise in writing.

The Client shall disclose known hazards and changes affecting fit, anchoring, sealing, or drainage, including altered thresholds, flooring, paving, openings, settlement, cracks, or damaged grout. Garrison may stop affected work when conditions are unsafe and will document required corrective action.

11. Storms, disasters, and service interruptions

The Plan does not include emergency deployment or removal, storm monitoring, evacuation assistance, or guaranteed service before a forecast storm. The Client remains responsible for emergency planning and timely deployment arrangements.

Garrison will not schedule or perform routine on-site service during an active hurricane, tropical storm, storm surge, flood, evacuation, or other disaster affecting the property or necessary travel route. Garrison may suspend confirmed appointments because of official watches, warnings, restrictions, or reasonably documented unsafe conditions. Work will resume only when safe access and working conditions are restored.

Neither party is responsible for delay to the extent caused by events beyond its reasonable control that actually prevent performance. The affected party shall give prompt notice and use reasonable efforts to resume. If interruption exceeds 30 days, the Client may accept an extension or cancel and receive a refund of the service fee.

12. Excluded work and travel charges

Unless expressly included in the Service Order, the Plan excludes deployment, removal, drills, storm cleanup, off-site storage, major component replacement, structural repairs, extensive surface or sealant remediation, pumps, monitoring, engineering services, and water-load testing. Routine re-caulking remains included.

Additional work requires a written scope and price accepted by the Client before work begins. A Client-requested dedicated or emergency trip may incur separately quoted service, travel and lodging charges, accepted in advance.

13. Product warranty and service workmanship

This Plan does not extend, restart, pause, or revive the original two-year product warranty, measured from the original delivery date. The applicable written product or installation warranty governs coverage, remedies, claim procedures, shipping, labor, and travel. Any additional warranty requires a separate written endorsement. Plan cancellation does not automatically void the original warranty.

Garrison will perform services professionally and in accordance with its applicable procedures. If the Client reports a service deficiency within 30 days of completion, Garrison will investigate and correct any deficiency attributable to its work without additional labor or necessary travel charges. If correction cannot reasonably be provided, Garrison will refund the corresponding service charge.

14. Flood risk, property damage, and liability

The Plan is maintenance, not insurance or a guarantee against flooding. Inspection does not certify future performance or eliminate risks from overtopping, entry through other building areas, unsuitable supporting surfaces, delayed deployment, or conditions outside the System's design limits. The Plan does not replace property or flood insurance.

Each party shall indemnify the other against third-party bodily-injury or property-damage claims, including reasonable associated defense costs, only to the extent caused by its negligence, willful misconduct, or breach of this Agreement. Neither party shall indemnify the other for the other party's own negligent or wrongful conduct.

To the extent permitted by law, Garrison's liability for ordinary economic losses arising solely from breach of this Plan is limited to the service fees paid for the applicable service year. This limit does not apply to bodily injury, physical property damage caused by Garrison, gross negligence, intentional misconduct, existing product-warranty remedies, or rights that cannot lawfully be limited.

15. Suspension, termination, and refunds

Garrison may suspend affected work for unsafe conditions or material noncompliance with the supplied care, storage, or operating instructions. Except where immediate suspension is necessary for safety, Garrison will identify the deficiency and corrective action in writing and allow 30 days to correct it. Garrison may suspend or cancel the service Plan at its discretion and at any time and will offer a refund to the fees paid.

The Client may cancel by written notice, subject to Section 9. Refunds will reflect unearned services and benefits, less only lawful, disclosed charges and preauthorized nonrecoverable expenses, with an itemized calculation. Completed services remain payable; after the annual visit, any refund is limited to remaining unearned value. Enrollment alone does not earn the entire fee.

16. General terms

Florida law governs. These Terms and the Service Order, including identified schedules, govern maintenance without replacing the original product or installation warranty. Amendments and property transfers require written acceptance. Send notices to the listed contacts. Electronic signatures are accepted. Invalid provisions do not affect remaining terms. The parties will seek good-faith resolution of any disputes without limiting urgent relief or statutory filing deadlines.
